A judge in Oregon has ruled that naming your shop after yourself is a trademark violation if your name is too similar to that of a big corporate brand.
A woman named Sam Buck opened a coffee shop in Astoria, Oregon in 2000, two years before a Starbucks opened down the road. She named her shop Sam Buck's, and the judge in her case said that she willfully infringed on Starbucks's trademark in so doing.

Owner Sam Buck named the store after herself. She opened it in 2000, before Astoria had a Starbucks. She got a cease-and-desist letter from the Seattle-based company in March of 2002.
Buck said Thursday that she had few details of a ruling Tuesday by U.S. District Judge Ancer Haggerty of Portland. She faces hundreds of thousands of dollars in lawyers' fees.
"The judge said I willfully infringed on (Starbucks') trademark, that I diluted their trademark," she said.
She was faced with erasing all traces of the name, from coffee cups to the sign outside to business cards.
"You're throwing away thousands of dollars worth of stuff," Buck said, "and you're left paying thousands of dollars more to have new things made."
Starbucks, with more than 10,000 retail locations in North America, Latin America, Europe, the Middle East and the Pacific Rim, offered Buck $500 to drop the name.
She refused, and Starbucks sued.
She says she doubts people have trouble distinguishing her 10-foot-wide shop from a Starbucks, and that her business logo is not easily confused with that of Starbucks.
Starbucks has since opened a store in Astoria a mile east, in a Safeway building.
Starbucks spokeswoman Lara Wyss said the company is "pleased with the court's decision."
"While it is always Starbucks' preference and desire to resolve disputes of this nature informally ... we will seek the assistance of the courts to protect our trademark when we are unable to resolve the matter through alternate means," Wyss said in an e-mail.
Buck says legal costs will be a stretch but she doubts she will close.
"It keeps your motivation going," she said. "I think it will be OK."
Community support has given her added incentive.
"We're standing up for small business because corporate America is squeezing out the small businesses," Buck said. "It's real and it's going to happen if we don't do something."

If someone infringes on your trademark, or even appears to be infringing upon it, you have to fight vigorously to protect it or you risk losing it. Not to defend the evil empire, but what they did to this woman is completely reasonable in the proper legal context. The last thing Starbucks wants is to become the next Xerox... -

Fri, December 2, 2005 - 4:05 PMThe law is actually very skeptical of trademarks, which is why it's so easy for companies to lose their marks. If it were more rigorous in defending trademarks, big companies like Starbucks wouldn't have to worry so much about dillution and they wouldn't bother wasting their American dollars on small fry like Sam Buck. This isn't about Starbucks squashing the competition, it's more about Starbucks not losing it's right to be the one and only Starbucks.

Fri, December 2, 2005 - 5:38 PMAm I the only one who's missing the big point here? There is no risk of confusion between "Starbucks" and "Sam Bucks." You'd have to be too stupid for words to walk into "Sam Bucks" and think you're in "Starbucks." It seems to me that the court sided with the mega-corp at the expense of the little guy. Surprise. Thing about federal judges is they're appointed for life which gives them carte blanche to make aweful decisions without any accounatability. But... being an attorney for 12 years, what would I know? One more reason to pass on the moca floopy doopy tripple soy no-sugar half decaf machiato-datto-blatto. -
